1. General

  1. All capitalized terms not defined herein shall have such meanings as have been assigned to them respectively in the Terms. The rules of interpretation contained in the Terms shall also apply to this Privacy Policy. This Privacy Policy is at all times required to be read along with the Terms.

A high standard of security is maintained by Cherisher for Users. However, the transmission of information via the internet and web networks is not completely secure. While Cherisher does its best to protect Users’ information, particularly concerning the protection of Users’ data, Cherisher cannot ensure the security of Users’ data transmitted via the internet, web network, or any other networks.

If a User communicates with Cherisher by, for example, e-mail or letter, any information provided in such communication may be retained by Cherisher.

Cherisher may receive information about the User from other online sources. Cherisher may add it to its account information system and treat it by the Privacy Policy. Cherisher may obtain updated contact information(s) from third parties to correct its records and fulfill the Services or to communicate with the User.

If the User links connect or login to its Cherisher account with third-party services they may send Cherisher information such as User’s registered e-mail id and public profile information.

Cherisher may reference other sources of demographic and other information to provide the User with more targeted communications and promotions. Cherisher uses various third-party analytics service providers, among others, to track User behavior on our Website. They are used to support display advertising towards helping Cherisher gain an understanding of the Users’ demographics and interests. The reports are anonymous and cannot be associated with any individual personally identifiable information that the User may have shared with Cherisher.

(d) Transactional and Billing Information

When the User makes any transaction on the Website, Cherisher’s payment gateway provider may collect the User’s personal information such as address or billing information, including credit/debit card number and expiration date, etc. This information is stored by the payment gateway partner and such payment gateway partners are not controlled by Cherisher. The User visits such payment gateways at its own risk. Cherisher encourages the User to familiarize themselves with the privacy statements provided by such payment gateways before providing them with information or entering into any transactions with them. Cherisher does not assume any responsibility or liability for such payment gateways, the content of such payment gateways, and their privacy practices, nor does it endorse them.

Cherisher may receive financial or transactional information (e.g., transaction ID, order ID, etc.) from third-party vendors in case of payments, for reconciliation and validation of transactions, and also for resolutions of complaints (in case of failed transactions and refunds).

2. Cherisher uses its best efforts to use Users’ information in aggregate form (so that no individual user is identified) for the following purposes:

(a) To build up marketing profiles;

(b) To aid strategic development, data collection, and business analytics;

(c) To manage relationships with advertisers and partners;

(d) To audit the usage of Services; and/or

(e) To enhance the User’s experience about the provision of Services (“collectively, “Permitted Use”).

3. Cherisher reserves the right to disclose Personal Information if required to do so by law or if Cherisher believes that it is necessary to do so to protect and defend the rights, property, and/or personal safety of Cherisher, the Services, or other Users.

4. Confidentiality and Security

Except as otherwise provided in this Privacy Policy, Cherisher will keep all Personal Information private and will not share it with third parties, unless Cherisher believes in good faith that disclosure of such Personal Information or any other information Cherisher collects about Users is necessary for Permitted Use or to:

5. Security

1. The security of Users’ Personal Information is important to Cherisher. Cherisher follows generally accepted industry standards to protect the Personal Information submitted to Cherisher, both during transmission and once Cherisher receives it.

2. Although Cherisher makes the best possible efforts to store Personal Information in a secure operating environment that is not open to the public, Users should understand that there is no such thing as complete security, and Cherisher does not guarantee that there will be no unintended disclosures of Personal Information. If Cherisher becomes aware that certain Personal Information has been disclosed in a manner, not by this Privacy Policy,  Cherisher will use reasonable efforts to notify the concerned User of the nature and extent of such disclosure (to the extent Cherisher is aware of that information) as soon as reasonably possible and as permitted by law.

6. Updates and Changes to Privacy Policy

Cherisher reserves the right, at any time, to add to, change, update, or modify this Privacy Policy. Users are requested to review this Privacy Policy frequently. If any change has been incorporated in this Privacy Policy by Cherisher, then Cherisher will post such changes on this page. In all cases, the use of information Cherisher collects is subject to the Privacy Policy in effect at the time such information is collected by Cherisher.

7. User's Right

1. Users have a right to correct any errors in such User’s Personal Information available with Cherisher. A User may request Cherisher in writing that Cherisher ceases to use such User’s Personal Information. Cherisher may stop providing Services to such a User if so required.

2. For withdrawing consent at any time with Cherisher, the User may choose to do so by sending Cherisher an email. Cherisher shall review such requests and may ask the User to verify its identity. Post verification Cherisher will withdraw the consent for which the request was made by the User and stop any further processing of its Personal Information.

8. Complaints

The User can write to Cherisher in case of any grievance or complaint at the support email address. If the User has any complaints regarding the processing of its Personal Information, the User may contact the office at the below-mentioned email address.

9. Restriction of Liability

1. No warranty of any kind, implied, expressed, or statutory, including but not limited to the warranties of non-infringement of third-party rights, title, merchantability, fitness for a particular purpose, and freedom from computer virus, is given concerning the Services provided by Cherisher, including the provision of Website.

2. Any reference on the Website to any specific commercial products, processes, or services, or the use of any trade, firm, or corporation name is for the information and convenience of the public and does not constitute endorsement, recommendation, or favoring by Cherisher.

3. Services provided by Cherisher only include the provision of an online platform for facilitating buying and selling of Art Work and promotion of art, unless otherwise expressly provided in the Terms. The products made available through the sale services are sold on an ‘as-is’ basis and Cherisher has no responsibility concerning the adequacy, relevancy, or authenticity of such products listed by other Users. Cherisher is not responsible for any information provided by one User to the other User in the course of Service and this Privacy Policy governs Cherisher’s relationship with the Users only concerning the information provided by the Users to Cherisher and/or the information collected by Cherisher from the Users.
